The regular meeting of the International Executive Council was called to order at 8:30 a.m., by Chairman Pierson, on Tuesday, December 13, 2011, in Washington, DC. Other members of the council in attendance were Smith, Furer, Riley, Walter, Lavin, Calabro, Calvey and Clarke. International President Hill International President Edwin D. Hill met with the members of the International Executive Council a number of times to discuss a variety of matters affecting all branches of the Brotherhood. International Secretary-Treasurer Chilia International Secretary-Treasurer Salvatore (Sam) J. Chilia presented financial reports covering the IBEW Pension Fund and the Investment Portfolio of the Brotherhood both in Canada and in the United States. Legal Defense Payments for legal defense, made from the General Fund, were examined and approved in accordance with the requirements of Article X, Section 1, of the IBEW Constitution. Financial Reports The International Secretary-Treasurer's Reports for the various funds of the Brotherhood were presented to the members of the International Executive Council, examined, approved, and filed. Local Union(s) Under International Office Supervision International President Hill advised the council members that there are no local unions under the supervision of the International Office, at this time. Financial Statements For Political Education Reviewed and Filed IBEW and Subsidiaries — Reviewed and Filed IBEW Headquarters Building LLC — Reviewed and Filed Trust for the IBEW Pension Benefit Fund and Subsidiaries Consolidated Financial Statements September 30, 2011 Reviewed and Filed Pension Plan for International Officers, Representatives and Assistants of the IBEW Reviewed and Filed Pension Plan for Office Employees of the International Reviewed and Filed Article XX and XXI Cases During 2011, the IBEW was involved in one dispute under Article XX of the AFL-CIO Constitution, Manhattan College, in Riverdale, New York, (UNITE/HERE and IBEW Local Union 1158). A mediation of this dispute is scheduled for January 11, 2012. There were no disputes involving organizing responsibilities under Article XXI. Charges Filed with the International Executive Council On June 24, 2011, Brother Daniel A. King, at the time, a business representative of Local Union 1, IBEW, preferred charges against Peter W. Nicholas, Card Number D431764, a retired member of Local Union 1, presently receiving IBEW Pension Benefits, for allegedly violating Article XI, Section 6(d), of the IBEW Constitution. The record reflects that Brother Peter Nicholas admitted to performing electrical work in December 2010. In April 2011, he applied for and was granted IBEW Pension disability benefits retroactively commencing in September 2010. On August 1, 2011, International Secretary-Treasurer Salvatore Chilia suspended IBEW disability benefits until this matter has been investigated and decided by the IEC. After a thorough review of the facts presented in this case, the members of the executive council find no violation to Article XI, Section 6 (d). However, Brother Nicholas did in fact receive retroactive disability benefits for December 2010 while admitting to performing electrical work. Therefore, he will have to repay one month of IBEW disability benefits. As such, International Secretary-Treasurer Chilia will return Brother Nicholas to pension status one month after his suspension date. Appeal Filed with the International Executive Council Christopher Yerian's is appealing a local Union 117 Trial Board decision to the members of the executive council. The facts of this case were reviewed and considered. After a thorough review of Brother Yerian's appeal, it is the decision of the executive council members that International President Edwin D. Hill properly advised former member Christopher Yerian that his appeal to him was untimely and that he was no longer an IBEW member and forfeited his right to appeal. The IEC concurs with President Hill's letter dated August 26, 2011. Appeal Filed with the International Executive Council Christopher Yerian's is appealing a local Union 150 Trial Board decision to the members of the executive council. The facts of this case were reviewed and considered. After a thorough review of Brother Yerian's appeal, it is the decision of the executive council members that International President Edwin D. Hill properly advised former member Christopher Yerian that his appeal to him was untimely and that he was no longer an IBEW member and forfeited his right to appeal. The IEC concurs with President Hill's letter dated August 26, 2011. Amendment to Pension Benefit Fund's (PBF) International Executive Council Chairman Pierson introduced, and the members of the International Executive Council unanimously adopted, an updated amendment to delegate discretionary authority to the International Secretary-Treasurer to immediately suspend (subject to an abundance of proof) a member's pension upon learning that the member has returned to the electrical industry and to initiate an investigation. IBEW Officers, Representatives and The members of the International Executive Council reviewed the actuary report and funding recommendations for the Plan. A motion was made and unanimously approved by the members of the International Executive Council to approve the actuarial recommendation for the funding policy of the Officers, Representatives and Assistants Pension Plan. A Resolution to update vesting of benefits was submitted and approved. Office Employees Pension Plan The members of the International Executive Council reviewed the actuary report and funding recommendations for the Plan. A motion was made and unanimously approved by the members of the International Executive Council to approve the actuarial recommendation for the funding policy of the Office Employees Pension Plan. A Resolution to update vesting of benefits was submitted and approved. Retirement of International Representative Gregory A. Teeple, International Representative Jimmy Sunvison, International Representative Jeremiah Comer, International Representative Retirement of International Office Employees Bernice Wright, International Office This regularly scheduled meeting was adjourned, on Wednesday, December 14, 2011, at 11:30 a.m. The next regular meeting of the International Executive Council will commence at 8:30 a.m., on Friday, January 20, 2012, in Naples, Florida.
